Because concrete coating projects can vary significantly depending on the existing surface and site conditions, the final scope, preparation requirements, materials, pricing, schedule, warranty, payment terms, and other project-specific requirements will be established in the applicable written project agreement.
Site conditions may affect the scope or cost of a project. These conditions may include, but are not limited to:
- Existing coating or sealer;
- Cracks, spalling, damage, or deterioration;
- Moisture or vapor conditions;
- Contamination, grease, oil, chemicals, or other substances;
- Surface profile and condition;
- Previous repairs or installations;
- Temperature, humidity, or other environmental conditions;
- Accessibility and site conditions; and
- Conditions that are not reasonably visible or identifiable during the initial estimate.
If conditions are discovered that require work outside the original scope, additional work may require a written change order or other written authorization before the additional work is performed.
The applicable project contract controls in the event of any conflict between these website Terms and the terms of a signed project agreement.
6. Colors, Samples, Photos, and Finishes
Images, photographs, color samples, chip blends, decorative finishes, and other visual representations displayed on this website are provided for illustrative purposes.
Actual colors and finishes may vary due to lighting, photography, display settings, screen resolution, substrate conditions, application methods, and natural variation in materials.
Website photographs are examples of completed work and do not guarantee that an identical appearance can be achieved at another property.
Customers should rely on samples and the specifications included in their project agreement when making final selections.
7. Scheduling and Availability
Submitting a request through the website does not guarantee an appointment, installation date, or project start date.
Project dates and schedules are subject to availability, weather, site conditions, material availability, customer readiness, and other circumstances that may affect the project.
Any scheduled date communicated through the website remains subject to confirmation by Better Concrete Coatings.
8. Payments and Contracts
Payment terms, deposits, progress payments, final payments, cancellation provisions, project pricing, and other financial obligations will be established in the applicable written project agreement.
Website Terms do not replace or modify any payment terms contained in a signed contract.
For Oregon residential projects, Better Concrete Coatings will provide written contracts and applicable consumer notices as required by Oregon law.
Oregon law requires written contracts for certain residential construction projects, including projects exceeding $2,000, and specifies information that must be included in those contracts.
9. Change Orders
Changes to the original scope of work may affect the project price, materials, schedule, or completion date.
Where applicable, changes will be documented through a written change order or other written authorization in accordance with the project agreement and applicable law.
A website inquiry, email, text message, or other informal communication does not automatically constitute approval of a change to a project unless accepted in accordance with the applicable project agreement.
10. Customer Responsibilities
Customers are responsible for providing accurate information regarding the property and project requirements and for complying with reasonable preparation instructions provided by Better Concrete Coatings.
Depending on the project, customers may be required to:
- Remove personal belongings or other items from the work area;
- Provide reasonable access to the property and work area;
- Keep unauthorized persons and pets away from the work area;
- Inform Better Concrete Coatings of known site conditions that may affect the work;
- Follow curing and post-installation instructions; and
- Maintain the completed coating in accordance with applicable care and maintenance recommendations.
Failure to complete required preparation or provide reasonable access may affect scheduling, project completion, or additional costs as provided in the applicable project agreement.
11. Site Conditions and Existing Surfaces
Concrete is a natural and variable substrate. Existing concrete may contain imperfections, cracks, discoloration, previous repairs, moisture, or other conditions that can affect the finished coating.
While Better Concrete Coatings will use reasonable professional practices to prepare surfaces and install coatings according to the applicable project specifications, we cannot guarantee that existing imperfections or conditions will be completely eliminated unless specifically included in the project agreement.
Certain conditions may be outside the contractor's reasonable control or may not be apparent until preparation work begins.
Any additional work required due to previously unknown or concealed conditions will be addressed in accordance with the applicable project agreement and change-order procedures.
12. Slip Resistance, Safety, and Floor Conditions
Concrete coatings are intended to provide a durable and functional surface; however, no flooring surface can be guaranteed to be completely slip-proof under all conditions.
Slip resistance may be affected by conditions including, but not limited to, water, rain, snow, ice, oil, grease, chemicals, dirt, dust, cleaning products, footwear, surface contamination, wear, maintenance, and other conditions outside of Better Concrete Coatings LLC's reasonable control.
Customers and property owners are responsible for maintaining the coated surface in a reasonably safe condition and for promptly addressing spills, standing water, snow, ice, oil, grease, or other substances that may create a slippery condition.
Where appropriate for the intended use and as specified in the applicable project agreement, Better Concrete Coatings may incorporate slip-resistant additives, textures, or other measures designed to improve traction. The selection and effectiveness of these measures may depend on the intended use of the area and the conditions under which the surface is used.
Customers are responsible for using the completed surface in accordance with applicable care, maintenance, and safety instructions provided by Better Concrete Coatings. Customers should exercise appropriate caution when walking on wet, contaminated, newly coated, or otherwise potentially slippery surfaces.
During installation and curing, areas may be wet, tacky, uneven, restricted, or otherwise unsuitable for foot or vehicle traffic. Customers, occupants, guests, children, pets, and other persons must stay out of restricted work areas until Better Concrete Coatings has determined that the area is safe for use.
Better Concrete Coatings is not responsible for slips, trips, falls, or other injuries or damages caused by conditions outside of its reasonable control, including customer or third-party actions, spills, contamination, improper maintenance, failure to follow safety or care instructions, inappropriate footwear, weather conditions, or use of the surface before it is approved for normal use, except to the extent liability cannot lawfully be excluded or limited.
Nothing in this section is intended to waive or limit any rights, remedies, duties, or liabilities that cannot legally be waived or limited under applicable law.
13. Warranties
Any warranty applicable to a project will be governed exclusively by the written warranty or warranty provisions contained in the applicable project agreement.
No information on this website creates a separate or additional warranty unless expressly stated in writing by Better Concrete Coatings.
Warranty coverage may be subject to exclusions, maintenance requirements, installation conditions, substrate conditions, misuse, abuse, normal wear, and other limitations specified in the applicable warranty.
